What if Spain's property records and boundaries disagree?

Do not pick whichever area looks most convincing. Match the property in the seller's title, the Land Registry and Catastro, Spain's cadastral register, then compare its perimeter with the ground. If a discrepancy affects the purchase, commission technical checks and agree how it must be resolved before paying the purchase deposit, called arras.

A fence, a cadastral map and a Land Registry description may outline different land. Establish which perimeter the seller can transfer before committing to the purchase.

How do you establish which land the seller is offering?

Start with the perimeter, rather than a comparison of advertised square metres. Ask the seller to walk the boundaries and point out the entrance. Give your lawyer the title and Registry information, and give your surveyor the cadastral graphic. They need to identify the same piece of land in each record.

The finca registral is the property unit recorded in the Registro de la Propiedad, Spain's Land Registry. A parcela catastral is a mapped cadastral parcel. The two are not automatically interchangeable: a Registry description can include references for several cadastral properties. Do not assume that a familiar address or property name establishes the match.

Keep land area separate from the area of buildings. This guide concerns the land perimeter. For ownership and entries affecting the property, use the nota simple guide, then ask for further Registry evidence where the boundary needs it.

A comparison of totals can miss the problem. Different polygons can enclose the same area. A disputed strip at the entrance may matter more than a larger discrepancy elsewhere. Graphical coordination does not by itself establish a right to cross someone else's land. Have your lawyer check the legal basis for using any outside section of the access route, including the terms of any servidumbre de paso, a right-of-way easement. Mark the questionable section, access and intended building location on a shared plan, so your advisers can explain what the difference means for this purchase.

Assessment routes, not guaranteed approvals. A technician compares the geometry; the lawyer, notary or registrar identifies the procedure. Choosing the larger polygon cannot settle a dispute over ownership.

Does Catastro, the Registry or the fence decide the boundary?

Catastro is an administrative property register containing mapped descriptions and other property data. Its information is presumed correct unless disproved, without prejudice to the Registry, whose legal pronouncements prevail (Cadastre Act, TRLCI, art. 3). That does not make every historical Registry area an accurate modern measurement.

A nota simple is useful initial evidence about the property and registered rights, but it is informational and does not certify the entries (Land Registry Act, Ley Hipotecaria, art. 222.5). Where the boundary affects your decision, have your lawyer obtain the registered boundary plan and whatever formal Registry certification is needed.

Treat the fence as something to investigate. It shows an enclosure, but does not by itself establish that the seller owns everything inside. An aerial image is not a determination of title either. Your surveyor should distinguish the line seen on the ground from the line supported by the documentation. Leave markers and disputed access alone while rights are being checked.

What does cadastral coordination mean after Ley 13/2015?

Ley 13/2015 introduced the present system linking cadastral mapping with Registry descriptions. Its general commencement date was 1 November 2015; some provisions took effect earlier. It did not automatically coordinate all existing properties or require completed coordination for every ordinary sale thereafter.

A representación gráfica georreferenciada is a boundary graphic located through coordinates. It is compulsory on first registration and for the land-reordering operations specified in the law, including segregation, division and grouping. It can otherwise be incorporated voluntarily with a transaction eligible for registration or as a separate Registry operation (Ley Hipotecaria, art. 9).

Registry information must state whether the property is graphically coordinated with Catastro and the relevant date. Once coordination is achieved and the graphic is registered, the property's location and geographical boundary enjoy a legal presumption in accordance with art. 10. The presumption can be challenged. Art. 10.5 also extends it to a registered alternative boundary plan previously validated by a public authority, once six months have passed since its registration was communicated to Catastro without Catastro reporting obstacles to technical validation. A positive technical validation report alone, or six months since a survey, does not meet those conditions.

A cadastral reference printed in a deed does not prove coordination. Ask for the exact status and the graphic it concerns. Precoordinada is a status awaiting completed coordination, although the alternative boundary plan may already be registered. Pending processing or a map-displacement adjustment means further steps remain. On registration of the graphic, its area becomes the Registry area, correcting the previous written area where necessary.

The Registry rules discussed here are national. The cadastral framework described covers Andalucía, Comunitat Valenciana, Región de Murcia, Cataluña, Illes Balears and Canarias. País Vasco and Navarra retain special foral cadastral systems: do not assume the state cadastral website procedure is the right one there. Planning conditions and permission to divide land require a separate local and regional check.

When should you commission a boundary survey?

Use a competent topógrafo, a land surveyor, when the offered perimeter cannot be matched to the records or the difference could affect your access, usable land or intended works. A new field survey is not a statutory requirement for every purchase. If the seller provides an existing survey, ask your own adviser whether it addresses the present discrepancy.

Set out the deliverables before accepting a quote. Request a site comparison and a plan overlaid on cadastral mapping. The technical documentation should identify the affected cadastral parcels, date, method, resulting area and coordinates of the perimeter vertices. If alternative mapping is needed, include the electronic geometry files and validation work in the scope.

Measuring the inside of the fence is a different instruction from investigating the boundary you intend to buy. Ask the surveyor to identify any disputed strip separately. The surveyor takes responsibility for the technical work; your lawyer must assess the title and competing rights. A measurement does not transfer ownership.

An apparent mismatch against an aerial photograph can also come from shifted or rotated cadastral mapping. The 2020 technical resolution distinguishes this from an actual incursion into adjoining land. Displacement alone does not imply encroachment when shape and relationships between parcels remain unchanged. Have the technician explain whether the problem is map positioning, a different perimeter, or a combination requiring specific adjustment data.

What do GML files and positive validation actually establish?

GML is the electronic format used for the geometry of an alternative boundary representation. A representación gráfica alternativa, or RGA, proposes a graphic different from Catastro's in the situations allowed by law. The proposal must show the affected neighbouring parcels, including the portions that stay unchanged. Together, the resulting parcels must preserve the outer cadastral boundary of the original parcel or group. Redrawing only the seller's plot may leave the proposal incomplete.

An informe de validación gráfica, usually IVG or IVGA, checks technical suitability. A positive result does not prove ownership, authorise a division or replace the cadastral update procedure. Obtain the full report, its verification code and the geometry validated, so your advisers can match it to the proposal they reviewed.

To register an RGA, it must be expressly approved by the owner or by the judicial or administrative authority that decided the relevant procedure. Before signing arras, ask the seller to confirm the proposed plan in writing and identify who will pursue the correction. Technical validation does not establish that approval.

The current cadastral validation-help page says negative validation reports are no longer certified. Error information and downloads of proposed GML files remain available. If a proposed workflow relies on an old negative report, ask the technician how the submission will meet the current service requirements.

Is a difference of 5% or 10% automatically acceptable?

Neither percentage gives the seller extra land. They are conditions for particular area-correction routes. Ley Hipotecaria, art. 201.3, provides these shortcuts without the full rectification expediente, a formal correction procedure:

Difference in areaCorrection without the full expedienteCondition to check
No more than 5% of registered areaArea correction under art. 201.3.bRegistrar must have no well-founded doubts about the proposed correction
No more than 10% of registered areaArt. 201.3.a, using the descriptive and graphic cadastral certificateCertificate and Registry description must identify the same property, with no well-founded doubts

Registered adjoining owners are notified after these corrections. Correcting the written area through this route does not by itself register a georeferenced perimeter or complete coordination. A small difference can still raise doubts, particularly where a previous segregation already determined the area precisely.

A difference above 10% does not itself prove that the seller lacks title to the land. It falls outside the quoted shortcut. Your advisers need to establish property identity and select a suitable fuller procedure. Conversely, being below a threshold does not establish that the proposed line is correct.

Which procedure corrects the Registry description?

If cadastral mapping correctly represents the property, a registered owner can seek incorporation of that boundary through art. 199.1. The registrar notifies affected registered adjoining owners. The law's twenty-day period is for representations following notification, not the time needed to finish the process.

Where Catastro does not reflect physical reality, art. 199.2 allows an alternative boundary plan alongside the cadastral certificate. Affected cadastral adjoining owners are notified too. Once registered, the graphic is sent to Catastro; completing coordination requires the cadastral alteration and communication back to the Registry.

The registrar must refuse a graphic that overlaps another registered boundary plan or public land, wholly or partly. Other representations receive a reasoned assessment. An objection does not automatically block registration, but a technically valid file does not guarantee approval. Ask your lawyer to review the actual objection and any previous refusal.

A separate option is the notarial rectification procedure under art. 201.1 for a property's description, area or boundaries. The applicant must establish that the differences are descriptive errors, rather than an unregistered transfer or legal change. It has exclusions, including descriptive correction of buildings or horizontal-property units and properties resulting from an administrative procedure for reorganising land ownership, expropriation or boundary determination. The property's history determines the appropriate route.

Objections have a different effect here. If an interested party objects and states the grounds, the notary closes and archives the file, under the cross-reference to art. 203, rule six. Your lawyer must then assess the court route. Do not apply art. 199's approach to assessing objections to this notarial procedure.

How is an error in Catastro corrected?

Under TRLCI, art. 18.1, subsanación de discrepancias is the administrative correction of a mismatch that does not arise from failure to declare or communicate an alteration. The authority initiates it when it learns of the discrepancy. You can submit evidence to bring the problem to its attention; sending a request is not the same as having a procedure formally initiated or a new boundary accepted.

In the ordinary procedure, there are fifteen days to make representations. The maximum for notifying an express decision is six months from notification of the initiation decision; expiry closes the file without approving your plan. Where no third parties are affected, Catastro can instead begin by notifying a proposed decision. If no representations arrive within fifteen days, that proposal becomes final. This does not mean a plan sent by an owner is automatically accepted or Registry coordination completed.

Art. 18.2 also provides for notarial correction when a public document is executed. The parties are asked whether the cadastral certificate matches physical reality. If the discrepancy is sufficiently evidenced, affected neighbours are notified and have twenty days to make representations. Without opposition, the corrected description can be incorporated and communicated for technical validation. If there is opposition or insufficient evidence, the notary records and reports the discrepancy to Catastro. An isolated cadastral change does not replace the necessary Registry action.

What if the disagreement is about the boundary itself?

A deslinde is a procedure to establish a boundary, rather than merely replace an area figure. For registered private properties, the notarial route under art. 200 seeks agreement between the parties. It can concern only the disputed section, with cadastral certificates and supporting documents for the property and affected neighbours.

An agreement, including a partial one, is recorded in a public deed. Without agreement the notary closes the procedure and does not impose the proposed line. Your lawyer must then assess the options for resolving the dispute, including court proceedings where appropriate.

If the proposal actually transfers a strip from a neighbour, it cannot be disguised as correction of an old descriptive error. Nor can a boundary agreement replace the title and administrative approval needed for a genuine division (Land Act, TRLSRU, art. 26.2).

Does an area discrepancy change the agreed price?

The Registry percentages above do not determine your rights against the seller. Under Spain's common Civil Code, a price per unit of area and a lump-sum price for the property follow different rules (arts. 1469, 1470 and 1471). With a lump-sum sale, an area difference does not by itself adjust the price. Failure to deliver the land promised within the agreed boundaries is a separate issue. Have your lawyer check both before accepting wording such as cuerpo cierto, a sale of the identified property as a whole.

If you have already bought, seek advice without waiting for the records to be corrected. Claims arising under those three provisions are subject to a six-month limitation period running from delivery (art. 1472). This is not a general deadline for every property claim. Your lawyer must establish the applicable civil law, what was not delivered and which remedy fits the case.

What should be agreed before you pay arras?

Aim to identify the property being sold and resolve the discrepancy that matters to your purchase. Making every document show an identical total is not enough. A filed application or an accepted survey quote is evidence of work started, not proof of correction completed.

Checks before paying the purchase deposit

  • Match the title, seller and registered perimeterLawyer and Registry · quote for review and Registry information · obtain and assess before signing
  • Compare the cadastral map with documents and the groundCompetent surveyor · quote for visit, plan and report · written schedule based on access and scope
  • Select the route and examine earlier objectionsLawyer, notary or registrar · quote for processing and notifications · timetable for the file, beyond the hearing period
  • Verify the final graphic and coordination statusLawyer, Registry and Catastro · include follow-up and final documents in the scope · check once correction is completed
  • Agree conditions for the reservation and arrasLawyer and seller · agree legal fees and allocation of correction costs · set the condition and deadline before payment

Do not pay the deposit yet if…

  • The seller cannot match the offered perimeter to the title being transferred.
  • The discrepancy includes the entrance or a strip your project depends on.
  • A neighbour's objection, registered overlap or possible public-land boundary remains unresolved.
  • A cadastral reference or positive IVG is offered as the only evidence that correction is complete.
  • Your contract requires completion even if the necessary procedure fails.

If you proceed while work is pending, have the contract identify the agreed plan, the documentary result required, the payer and a negotiated deadline. Specify what happens on refusal or delay, when money must be returned and how any agency reservation payment is treated. Use the arras contract guide when reviewing those terms.

Do not assume a discrepancy automatically entitles you to a refund. Under the national Civil Code, art. 1454, arras penitenciales allow withdrawal with loss of the buyer's deposit, or repayment of double by a withdrawing seller. Your lawyer needs to establish the type of arras and applicable civil law, then draft the separate protection for this boundary problem.

Frequently asked questions

Can I buy a property that is not coordinated with Catastro?

Lack of coordination does not by itself prevent an ordinary sale. A transaction involving an operation for which a boundary plan is compulsory is different. Establish the property's perimeter and investigate discrepancies affecting your intended use before committing.

Is a discrepancy below 5% corrected automatically?

No. The registrar must have no well-founded doubts for that shortcut. It does not establish that a fence is correctly placed or complete graphical coordination by itself.

Does a positive graphical validation report prove ownership?

No. It checks technical requirements for the proposed geometry. Title, necessary authorisations and registration need their own evidence and procedures.

Do I need every neighbour to sign my plan?

The procedure and affected rights determine what is needed. Art. 199 provides for notification and assessment of representations. Under art. 201.1, an interested party's objection stating its grounds ends the notarial correction file. A notarial deslinde seeks agreement and closes without it. Ask which route is proposed before collecting signatures.

How long does correcting the area take?

Obtain a timetable for your particular file. The twenty days under art. 199 are for representations. The six months in cadastral art. 18.1 run from notification of initiation and do not guarantee a favourable decision. Neither is a universal total duration.
