Buying in Spain: which community debts and costs follow the home?

14 min · Updated

In this article

Obtain the community debt certificate and a separate schedule of approved payments that have not fallen due. Under Spain’s national Horizontal Property Law (LPH), the property is liable for previous owners’ unpaid general expenses already due for the purchase year and those attributable to the previous three calendar years. Catalonia includes four previous years. Check any estate conservation entity separately: its obligations do not automatically have the same limit.

Ask for these before paying

  • An updated debt certificate identifying the property you are buying
  • Meeting minutes, current budget and approved assessments (extra contributions) with due dates
  • Documents establishing the community, its rules and your share of costs
  • Separate documents and account statement for any conservation entity

Before paying a deposit, check the owners’ association account and future extra charges. A detached house can have shared estate costs too, including a separate obligation to maintain public infrastructure.

Can a detached house or an empty plot have community fees?

A comunidad de propietarios is an owners’ association managing common property and expenses. You may encounter one when buying an apartment, but also when buying a detached house on an estate. Separate plots can share roads, infrastructure or services in a private property complex covered by LPH article 24. A private garden and your own front door do not establish that there are no shared costs.

Ask for the título constitutivo, the document establishing the community and its properties, and the estatutos, its governing rules. The cuota de participación is the property’s percentage share; check whether particular expenses use a different allocation. Have your lawyer identify each community you would pay. There may be one for the building or phase and an agrupación de comunidades, a group of communities, for the wider estate. A certificate from the building does not settle the estate account.

The seller saying that there is no professional administrator is insufficient. The LPH can apply to qualifying communities without a formal constitutive title, and the president may perform administration functions. Conversely, sharing a rural track does not by itself establish horizontal property ownership. Your lawyer must identify the actual arrangement rather than infer it from the way neighbours collect money.

A further body, an entidad urbanística de conservación, can have responsibility for maintaining the development’s infrastructure. It has an administrative role. Keep its account separate from the private community account even if the same office handles both.

How much of the seller’s unpaid account can affect your purchase?

LPH article 9.1.e attaches liability to the dwelling or commercial unit itself for certain previous owners’ unpaid general community expenses. The window covers amounts already due for the acquisition year and amounts attributable to the three preceding calendar years. Registering your ownership does not remove this statutory exposure.

This is afección real, liability attached to the property. It does not make every debt the seller has ever incurred your personal debt. The community can seek recovery against the home within this statutory limit. Have the account broken down by expense, the period it belongs to and when payment fell due.

For a purchase on 19 October 2026, the national window covers amounts already due for 2026 and those attributable to the calendar years 2023, 2024 and 2025. Do not count backwards from completion as if this were a rolling period. Later amounts falling due during 2026 need assessment as obligations arising while you own the property.

Illustration for an acquisition on 19 October 2026. This shows the property’s exposure to earlier debts, not a limitation period for the seller’s debt or a schedule of future assessments.

An older debt falling outside this window has not thereby been proved extinguished. A registered attachment, an existing claim or a contract in which you agree to assume debt needs separate legal review. Obtain the nota simple, the Land Registry extract, alongside the certificate. The Registry position and the community account answer different questions.

What certificate should the seller provide?

The certificado de deudas is the community’s formal statement of the property’s debt position. Under the LPH, when the transfer deed is signed before the notary, the seller must declare whether community expenses are paid or specify the debt, and supply a matching certificate. The person acting as secretary issues it with the president’s approval. The issue deadline is seven calendar days from the request.

Ask for it while investigating the property, before signing arras, the private deposit agreement. Arrange an update for the escritura, the public sale deed signed before a notary. Check that the certificate identifies the correct property and seller, states its date and has the required signatures. Where a garage, other annex or another community has a separate account, establish what each certificate covers.

A direct-debit receipt shows the payment it records. It is not the statutory statement of the whole account. If the seller provides only recent bank receipts, request the formal certificate and reconcile them with it.

The seven-day deadline concerns issuing the document; it is not a seven-day expiry rule. Ask for a fresh balance if another bill falls due before signing. Confirm how the request is made and whether any charge is quoted, rather than assuming a standard certificate fee.

If the certificate lists debt, agree a verifiable payment arrangement before committing. One possibility is a negotiated payment to the community out of the sale price; another is an agreed retention with clear release conditions. Identify who receives the money and what evidence confirms settlement.

Before setting a retention, obtain a closing statement separating principal, interest and claimed recovery costs. LPH article 21 provides for interest and recovery costs; your lawyer must check which claims are justified and against whom. Where proceedings or an attachment exist, agree how their closure or discharge will be evidenced. A receipt for community contributions does not establish that those steps are complete. There is no automatic holdback simply because a certificate shows debt.

Who pays an assessment agreed before completion?

A derrama is an additional contribution, often collected to fund work beyond the ordinary budget. The useful questions are what the money is for, what the owners approved and when each amount becomes payable. The meeting date alone does not allocate every instalment to the seller.

For improvements the property must contribute to, LPH article 17.11 makes the owner when payment becomes due responsible. An improvement approved before completion can therefore leave you with later instalments. Request the full payment schedule.

Check any claimed exemption too. Under article 17.4, a dissenting owner can be exempt from certain unnecessary improvements where the installation contribution exceeds three ordinary monthly community payments. Obtain the minutes and evidence of any exemption claimed by the seller. Have your lawyer establish whether it affects the payments demanded from the property after purchase.

The wording concerns improvements. Necessary maintenance and conservation works have a separate basis in article 10.1.a, while article 10.2.a addresses allocation and payment terms. Ask your lawyer to classify the work and inspect the resolution instead of treating every exceptional bill as an optional upgrade. Catalonia requires its own legal analysis, explained below.

You can agree that the seller will cover a specified assessment, including future instalments. Civil Code articles 1255 and 1257 allow contractual agreements within legal limits and generally bind the contracting parties. Your agreement does not, by itself, change whom the community can require to pay.

Make the wording usable: identify the work, the instalments included and the payment mechanism. If the final cost is unsettled, agree how increases and any financing payments will be handled. A promise that the seller will “pay the derrama” leaves room for disagreement over what that includes.

Does a paid-up certificate mean there are no further costs?

No. A zero arrears balance is a statement about the account, not a warranty about the building or its future spending. Under the LPH, explicitly request approved assessments that are not yet due. Read the relevant minutes and any available technical reports too. Required work may have been identified before the community has decided how to fund it.

Request the current budget, latest approved accounts, minutes concerning pending work and any financing commitments. Ask about litigation over the work or assessments. Under LPH article 18.4, challenging a resolution does not suspend its execution unless a judge orders an interim suspension. If the seller says a challenge means no payment is needed, ask for that court order.

Have the seller obtain the documents or authorise access through the administrator; a prospective buyer does not have unrestricted access to owners’ records.

The LPH reserve fund must be at least 10% of the latest ordinary budget. A group of communities has the exception in article 24.3.c unless agreed otherwise. This statutory minimum does not tell you whether the structure, drainage or other shared installations need work. Ask what cash is available for the projects discussed in the minutes.

Not using the pool or visiting the house only occasionally does not, by itself, exempt an owner from common expenses, subject to the applicable legal exceptions. Nor should you assume the total budget is divided equally between homes. Check the property’s share and any special allocation. Other owners’ arrears can create a cash-flow problem for the community; they are not an automatic personal transfer of those neighbours’ debts to you.

What is different when the property is in Catalonia?

Catalonia has its own horizontal property rules in the Catalan Civil Code. Under article 553-5, the property is liable for unpaid ordinary and extraordinary common expenses and reserve contributions for the part of the current year already due and the four preceding calendar years. In the October 2026 example, that adds 2022 to 2023, 2024, 2025 and amounts already due for 2026.

The Catalan certificate must also list approved ordinary expenses, extraordinary expenses and reserve contributions that have not yet fallen due. Read this future-payment information even if the certificate says there are no arrears. The seller remains responsible for debt owed at transfer, without prejudice to the property’s statutory exposure.

The secretary issues the certificate. Presidential approval is unnecessary where a professional manages the community and acts as secretary. Article 553-5 does not prescribe the national seven-day issue deadline: agree a delivery date rather than presenting that deadline as Catalan law.

Under article 553-6, the budget must allocate at least 5% of common expenses to the reserve fund. The selling owner cannot demand that their reserve contribution be returned on sale. Assessments need review under articles 553-30 and 553-45; do not transplant LPH article 17.11 into Catalonia.

For Andalucía, Comunitat Valenciana, Región de Murcia, Illes Balears and Canarias, the community civil-law rules described here are the national LPH rules. That does not make planning conservation obligations uniform across those regions. The next check is separate.

What does an estate conservation entity mean for a buyer?

An entidad urbanística de conservación is an administrative body involved in maintaining development infrastructure. It is different from an optional residents’ club. Under the state Urban Planning Management Regulations (RGU), membership is compulsory where planning or the applicable legal basis places the conservation duty on owners. The regulations also provide for a purchaser taking over membership and the relevant rights and obligations.

RGU articles 67–70 address conservation, cost allocation and possible administrative enforcement through apremio, a public debt-recovery procedure. These regulations must be read with the applicable autonomous planning law and the development’s actual file. Separately, article 27.1 of the national land law, TRLSRU, establishes continuity of the owner’s planning duties on sale. A finished-looking street is insufficient evidence that those duties are settled.

Ask the ayuntamiento, the town hall, to confirm whether the plot falls within a conservation entity and which infrastructure owners must maintain. Request the approved statutes, a boundary plan, the plot’s allocation and the current budget. Obtain an account statement covering arrears, approved future payments and any ongoing claims. Check outstanding development works and financing arrangements with both the entity and the town hall.

Do not assume the LPH certificate or its three-year lookback automatically applies. LPH article 2.e provides for application to conservation entities where their statutes so provide. Your lawyer needs those statutes and the administrative rules before determining the exposure to historical debt.

There is no single fee or fixed duration stated here for Andalucía, Comunitat Valenciana, Región de Murcia, Cataluña, Illes Balears or Canarias. The actual legal basis and financial commitments must be established for the development. Have the lawyer explain which obligations follow ownership and how any existing debt is to be settled.

Municipal adoption of roads does not by itself answer whether owners retain conservation duties. Ask for the formal reception documents and a written explanation of what remains payable. Where the costs involve service networks or connections, also check the utility supply arrangements.

What must be resolved before you pay arras?

Put outstanding checks into the arras contract. Name the documents, the delivery deadline and the result your agreement depends on. Negotiate what happens if the documents never arrive or disclose a debt or commitment you do not accept. Cover the return of reservation payments as well as arras. A missing certificate does not automatically give you the refund you hoped for.

  • Review minutes, budget, work and each assessment’s due datesSeller and administrator · confirm document costs · deliver and review before arras
  • Establish the title, statutes and property’s cost allocationYour lawyer · written fee quote · agree review date before payment
  • Verify conservation entity accounts and outstanding planning dutiesTown hall, entity and lawyer · ask about fees and legal charges · written answers before committing the deposit
  • Inspect defects or proposed work where the documents raise doubtsIndependent technical adviser · written scope and quotation · inspection and findings within the negotiated period
  • Agree debt payment, any retention and assessment allocationLawyer, seller and notary · confirm administration costs · terms in arras that can be carried out at completion

Do not pay the deposit yet if…

  • You are asked to waive the certificate without a verifiable account statement.
  • An assessment is approved but nobody can identify your share and its due dates.
  • The building’s account is provided while wider estate charges remain unexplained.
  • A conservation entity is called voluntary without documents supporting that position.
  • Substantial work or claims remain uncosted and the contract binds you to proceed regardless.

Reconcile the accounts again when preparing the deed. Under the LPH, coordinate the seller’s provable notification of the ownership change and provide an address in Spain for community notifications. Arrange future billing as part of the handover. Changing the direct debit alone does not settle the legal and financial questions above.

Already have a plot in mind?

Find it on the map, confirm the boundary and get the report as two PDFs (100 pages in English and 99 in Spanish in the sample report; the length of each order depends on the plot), with its sources and dates.

Frequently asked questions

Is a clean Land Registry extract enough to rule out community debt?

No. Statutory property liability can apply even to a registered purchaser. Use the Registry extract for the registered position and obtain the community certificate and outstanding assessment schedule separately.

Must the seller pay every assessment approved before the sale?

No. For improvements the property must contribute to under the LPH, ownership when each payment becomes due matters. Check any exemption. Necessary works require their own analysis, and Catalonia has separate rules. Put any agreed cost allocation with the seller in writing.

Can I buy a home whose seller owes community fees?

A purchase can be negotiated with a verifiable settlement mechanism. Have your lawyer reconcile the account and agree payment from the price or another accepted arrangement before you commit. The seller promising to pay after completion leaves exposure unresolved.

Does a debt-free certificate guarantee there will be no extra assessments?

No. Approved payments may not yet be due, and necessary work may still await a budget. The Catalan certificate must include approved future amounts; under the LPH, explicitly request the additional information.

Do conservation charges stop when the town hall receives the roads?

That alone does not establish that owners’ conservation duties end. Obtain the formal documents, statutes and applicable legal basis. Check the conservation entity’s account separately from the private owners’ association account.
