Does having electricity and water make the house legal?
No. Ask the ayuntamiento, the town hall, to confirm the permitted residential use, the applicable occupation document and whether the proposed utility works are allowed. Planning approval and occupation requirements arise separately under the consolidated Land and Urban Rehabilitation Law (TRLSRU, article 11).
Have your lawyer compare the municipal file with the actual house, including additions. If you are buying an empty plot, resolve whether a house can be built before spending money on connections. For an existing building with missing licences, use the guide to unlawful houses on rustic land.
At the viewing, locate the meters, water storage and wastewater system on a plan. Do they serve this property or a larger holding being split for sale? For shared equipment, request the agreement covering ownership, access and running costs.
Who can confirm an electricity connection?
The distribuidora, the local electricity network operator. A comercializadora is the retailer selling electricity to customers; an offer to sign a retail contract does not settle the network works (Electricity Sector Law 24/2013, article 6).
Give the distributor a plan, the precise supply location and intended use. Have an installer assess the power needed, including water pumping or sewage equipment. Request written technical and economic conditions showing the connection point and works. A nearby pole may belong to a network that cannot serve the house on the terms you expect.
For an existing connection, obtain a recent bill and contract, the supply identifier known as CUPS, and the contracted power. Match them to the property. Ask the distributor whether the supply is permanent, for construction works or otherwise provisional, and on what terms it can continue after purchase. Establish the documents needed to change the account holder, reactivate a disconnected supply or increase power. An old contract does not guarantee that increased demand needs no further works.
Request the certificado de instalación eléctrica, or CIE, commonly called the boletín: the electrical installation certificate. Spain's low-voltage regulations require technical documentation, installer checks and certification lodged with the regional authority (RD 842/2002, article 18). An electrical certificate does not certify the building's planning status.
Will the distributor pay to extend the network?
Under Royal Decree (RD) 1048/2013, article 25.1, the local distributor builds the new extension for a new supply or power increase up to 100 kW at low voltage or 250 kW at high voltage where the land was already urbanised and had the legally required infrastructure and services before that electricity need arose. The applicant pays the applicable extension charges.
Both conditions must be met; small household demand alone is insufficient. Ask the town hall for evidence of the land's status and the distributor for its cost classification. An agent's description or the Catastro cadastral system's tax classification does not settle this test.
For the remaining new extensions, the applicant funds the extension works. The distributor must not also charge derechos de extensión, extension charges, for that same applicant-funded extension (article 25.2). Access charges and other applicable items remain separate. Find out the full works cost before treating a rural plot as affordable.
In this route, the distributor must supply the technical specification and financial estimate separately. They distinguish changes to its existing live network from the new extension. The distributor performs the former; the new extension can be built by an authorised installation company complying with its specification (article 25.3). Obtain competing prices for the same specified work.
If an applicant-built extension will serve more than one consumer, it must be transferred to the distributor, which then operates and maintains it (article 25.5). Whoever funded the installation may require a convenio de resarcimiento frente a terceros, an agreement governing contributions from later users, lasting at least ten years. It does not guarantee automatic or full repayment. When buying a property with an existing extension, request the agreement and check how contributions are calculated and collected, and what happens on sale. Disputes about extension payments go to the competent public energy authority (article 25.6).
How long should you allow for electricity?
Distinguish a deadline for a written offer from a date when the lights will work. RD 1955/2000, article 103.2.A, allows five working days for written conditions on low-voltage supplies up to 15 kW needing no extension. Other low-voltage cases needing no transformer installation have a ten-working-day deadline. These categories do not promise a rural connection within that period.
The itemised connection-charge notice must state its validity: at least three months from notification. Separately, in the applicant-funded extension route, you have a maximum of six months to expressly tell the distributor who will construct the extension; failure to do so causes the application to lapse and be archived (RD 1048/2013, article 25.4).
Distributor construction periods under article 103.2.B exclude time needed to obtain permissions, authorisations or consent. Ask for a programme identifying those dependencies. Have the route across any other land checked: permission to drive over a track should not be assumed to cover trenching or utility infrastructure.
Would solar panels let you live without a grid connection?
Possibly, if the system can meet your demand and the installation is permitted. Ask which legal and technical arrangement the proposal actually uses. Autoconsumo means electricity self-consumption; grid-connected self-consumption is regulated by RD 244/2019. An instalación aislada is a genuinely isolated installation, outside that decree's scope.
Isolation requires no physical capacity to connect to the public electricity network, directly or indirectly. Opening a switch does not qualify (articles 2 and 3). A grid-connected installation with batteries remains grid-connected under this test.
A no-export system needs an anti-export mechanism. Its generation is exempt from generation access and connection permits, but this does not remove other installation requirements. For exporting generation, the exemption for systems up to 15 kW depends on serviced urbanised land. Do not assume it applies to a rustic plot (articles 4 and 7).
For an isolated system, commission a design covering winter generation, usable battery capacity, simultaneous loads and pump starting, including water and sewage equipment. Request backup arrangements, replacement costs and a maintenance budget. Annual generation figures alone cannot establish winter performance.
There is also a planning restriction in Andalusia. For new isolated homes not linked to ordinary or extraordinary rural activities under Decreto 550/2022, article 31.1.g, basic services must be autonomous, preferably using renewable self-consumption. Network supply is exceptional, with the relevant sectoral authorisation and only connection works required. This is a rule for that category of house, not every existing rural property.
What proves the house has a lawful drinking-water supply?
The consolidated Water Law (texto refundido de la Ley de Aguas, TRLA) and Hydraulic Public Domain Regulations (Reglamento del Dominio Público Hidráulico, RDPH) govern the abstraction and discharge procedures below. In the Canary Islands, confirm both procedures with the island water council under its own legislation and plan.
For mains water, ask the municipal service or operator to confirm supply to the precise property for domestic use. Request the connection point, available flow and pressure, works and cost. Establish which occupation documents it needs. A pipe beside a rural track may carry irrigation water or belong to a private system.
For a well or spring, obtain the abstraction title and the authority's file. Check the holder, property served, permitted use and annual volume. A concesión is an administrative water-use grant; check its expiry and conditions too. An irrigation entitlement does not authorise domestic use. Nor does a grant guarantee that the stated flow will always be available (TRLA, articles 59.2 and 61.2). Have a technician assess the source's actual dry-season yield against your planned household demand. Ask the authority whether abstraction restrictions currently apply.
The national-law route for certain spring or groundwater uses on the same property up to 7,000 m³ a year has conditions and requires notification to the basin authority. It is not a general permission to drill. New works under that route in aquifers declared overexploited or at risk require authorisation (TRLA, article 54.2; RDPH, article 85). Check the actual title and the steps needed when ownership changes. The Canary Islands have their own water legislation.
Lawful abstraction does not prove drinking-water quality. Obtain recent laboratory testing and ask the health authority what treatment and monitoring apply, particularly if you intend commercial accommodation. RD 3/2023 contains exclusions and partial-application provisions, so identical requirements cannot be assumed for every private source.
For tanker deliveries, request the operator's authorisation, water provenance and delivery records. Under article 34, drinking-water supply by tanker beyond four months a year is exceptional and requires prior notification to the health authority for a favourable health report. Obtain that report and the town hall's confirmation that it accepts the arrangement before relying on year-round deliveries. A notification receipt is insufficient. Check access, storage maintenance and the continuing delivery bill.
Is an existing septic tank enough?
Begin by asking whether a public sewer connection is available, whether connection is required and on what terms. Discharges into an authority-managed sewer or collector fall to the competent regional or local body (TRLA, article 101.2). Obtain the connection level and route; pumping may be necessary.
Without a sewer, trace where the wastewater goes. Fosa séptica means septic tank, but that label does not tell you where its contents end up. A treatment tank releasing effluent into the ground differs from a watertight holding tank with no outlet, emptied by a collection service.
Infiltration can be an indirect discharge into groundwater, requiring prior authorisation where it may cause contamination (TRLA, article 100; RDPH, article 245). Ownership of the receiving land does not remove this requirement. The equipment's invoice or CE marking does not authorise that discharge at that location.
Have a competent technician check the actual system, proposed occupancy and disposal point. Ask the authority to confirm that the authorisation remains valid and covers this house, outlet and intended loading. Check expiry, renewal and the procedure for changing its holder. Budget for any applicable canon de control del vertido, the discharge-control levy (TRLA, article 101), as well as maintenance. Request maintenance records and check the permitted location relative to wells and watercourses.
For a genuinely sealed holding tank, confirm the applicable procedure and obtain the collection contract and receipts. The Segura basin authority offers an acreditación de vertido cero V0, a procedure to establish zero discharge. Elsewhere, ask the competent authority how to document the tank's status. Check tanker access and obtain a recurring emptying quote.
Which authority deals with water and discharge permissions?
Find the parcel on MITECO's basin-authority mapping. Water administration follows catchments; it does not simply follow regional or provincial boundaries. A confederación hidrográfica is an interregional river-basin authority. Internal basins are administered regionally. Planning and sewer enquiries still need the town hall or sewer operator.
| Area | Where to check |
|---|---|
| Andalusia | The Junta regional government for internal basins; the relevant confederation for interregional ones, such as Guadalquivir. For a new home not linked to rural activities, also check the connection restriction described above. |
| Comunitat Valenciana | The parcel's basin authority, including Júcar or Segura depending on location. TRLOTUP article 211.1.b.4 puts drinking water and wastewater treatment for the permitted isolated family house at the owner's expense. |
| Región de Murcia | Confirm the basin first. Segura is a relevant authority to consult, with discharge and zero-discharge procedures; that does not replace checking the parcel's location. |
| Catalonia | Agència Catalana de l'Aigua for internal basins; the relevant confederation for interregional basins, such as Ebro. |
| Illes Balears | The regional water administration. CAIB's current page describes authorisation for autonomous systems without sewer access. Ask it to confirm the file even if the seller has an older declaración responsable, a declaration of compliance. |
| Canary Islands | The island's Consejo Insular de Aguas, or island water council. Check the title and island plan under Law 12/1990; do not assume the national 7,000 m³ rule applies. |
What should be settled before paying a deposit?
Checks before paying arras, the purchase deposit
- Residential use, occupation paperwork and utility worksTown hall and your lawyer · municipal fee and agreed legal quote · request a written response date before payment
- Existing electricity supply or new connection termsDistributor and installer · itemised quotation, charges and validity · applicable offer deadline; separate works programme
- Routes over tracks and third-party landTechnician and lawyer · quoted survey, permissions and agreements · resolve before accepting the proposed connection
- Lawful domestic water and drinking qualityOperator or water authority, laboratory and health authority · quoted connection, investigation and monitoring · confirm availability and outstanding procedures
- Wastewater destination and paperworkTechnician and competent authority · quoted design, authorisation and maintenance · current authorisation where required; if pending, make purchase conditional on obtaining it
- Purchase conditions and repayment arrangementsYour lawyer and seller · agreed fee, including if you do not buy · set a deadline and consequences for missing or adverse answers
Have your lawyer identify the documents the purchase depends on, a total utility cost ceiling you accept and a deadline. If a required discharge authorisation is pending, make obtaining it a condition of purchase; knowing how to apply is insufficient. Agree the seller's cooperation and responsibility for changes of authorised holder. Expressly agree repayment if the specified utility condition fails. Cover any reserva, the reservation payment collected by an agent, in those arrangements.
Do not pay the deposit yet if…
- The only evidence is “electricity nearby”, with no written distributor terms for this property.
- The proposed route crosses another owner's land without documented rights, or needs an extension the town hall will not allow.
- The water entitlement covers irrigation only, its quality is unknown or domestic use remains unconfirmed.
- Nobody can identify the septic outlet or substantiate the discharge authorisation or holding-tank collections.
- Essential works are omitted from the budget, or the contract commits you despite unresolved utility feasibility.
