What can I build on a plot in Spain, and how do I confirm it before buying?

15 min · Updated

In this article

The applicable town plan, regional law and any separate land restrictions determine what you can build. Confirm that your use is allowed, how much floor area is permitted and where a building may sit. You also need to establish whether infrastructure or planning obligations remain. Before paying a deposit, obtain written planning information and an architect's feasibility assessment: the town hall's information certificate is not the building licence.

Ask for these before paying

  • Written planning report or certificate identifying the exact plot
  • Applicable zoning drawing and written ordinance, including amendments
  • Architect's assessment of your intended use and the building limits
  • Land Registry extract and deed, plus municipal details of outstanding duties and enforcement

The report shows the plot's Catastro data and mapped risks; it does not say whether you can build.

A plot sold as urban or buildable may still not take your house. Get the town hall's planning position in writing, then have an architect test your project against the local rules before paying a deposit.

How do I get an answer about this particular plot?

Ask the planning department, Urbanismo, at the ayuntamiento, the town hall. Give it the referencia catastral, the cadastral identifier, and a drawing marking the land you intend to buy. Describe the proposed use. An answer about an agricultural store is of little help if your plan is to live there.

Spanish national land law, the TRLSRU, gives people a right to planning information and a property's planning regime in writing (article 5.c–d). Ask which service to use: informe urbanístico, certificado urbanístico or cédula urbanística. Submit through the sede electrónica, the town hall's online portal, or ask its registration desk for assistance with filing. Follow the required procedure; keep the registration receipt and full reply.

A screenshot from a municipal map is a starting point. You need the written rules behind its coloured zone and any applicable area sheet. Check documents supplied by the seller against the land being sold: a certificate for the original holding may not answer the question for a smaller portion now offered separately.

Use your own architect to assess feasibility and your own lawyer for purchase terms. Ask both to identify missing evidence before agreeing a deposit date.

Which planning document should I ask for?

A PGOU is a general town plan. NNSS means Normas Subsidiarias, an older form of planning rules. Names differ between regions and generations of plans. A document is not obsolete simply because its title or approval date looks old: Andalusia's current land law, LISTA, preserves earlier instruments under its transitional provisions.

Request the plan in force and the amendments affecting the plot. Your architect may also need a plan parcial, a more detailed development plan, a plan especial for a particular purpose, or an estudio de detalle addressing local detail. Ask the town hall whether further planning has to be approved before a building licence can be obtained.

Read the zoning drawing together with its written ordinance. Request the approval and publication details, and ask about licence suspensions and proposed changes. Article 25 of the TRLSRU requires publication of final planning approvals and information about suspension areas in the documentation for plan-making or amendment procedures. A proposed future plan is not evidence that its building rules already apply.

If documents conflict, have the architect put the discrepancy to Urbanismo in writing.

Do classification and zoning tell me the same thing?

Clasificación is the statutory land class. Calificación concerns the more specific planning designation, including uses and building conditions. A plot can sit within a broad land class yet have a designation that does not permit your intended dwelling.

Ask for the detailed use, uso pormenorizado, and the particular building ordinance. A residential designation does not by itself establish that a detached house is permitted. The Valencia region's planning law, for example, places detailed uses, subzones, net buildability and subdivision parameters within detailed planning (TRLOTUP, article 35).

Do not substitute the Catastro's urban/rustic label for this enquiry. Catastro is the cadastral system and its categories follow cadastral law. They do not grant building consent. National land law also uses its own basic situations, rural and urbanised. Land awaiting completion of urbanisation remains rural for that law, even if planning allows future development (TRLSRU, article 21).

The guide to rustic, urban and urbanizable land explains those distinctions. Have the town hall identify the class and use rules for this plot.

How much can I build, and will it fit?

Commission a feasibility assessment with a layout on the actual boundaries. It should name the source of each parameter and the land area used. Before applying a net coefficient, clarify the planning alignment and any land to be given up for roads. Ask which area counts; the advertised area may not all qualify. Where boundaries or levels are uncertain, obtain a topographical survey.

The vocabulary below is illustrated by the published Carratraca PGOU, articles 146–148 and 151. Its definitions explain the concepts; its local numerical limits do not apply elsewhere. Your architect must use the ordinance governing your plot.

What is the difference between edificabilidad and ocupación?

Edificabilidad limits counted floor area. When expressed as a coefficient in m²t/m²s, it means square metres of floor area per square metre of land. Gross applies to a wider area such as a development sector; net applies to the net area or building plot specified by the ordinance. Do not multiply your cadastral area by a sector's gross coefficient and treat the result as an entitlement.

For a net coefficient, calculate eligible net land area × net coefficient = maximum counted floor area. Then test whether that floor area fits within the other limits.

The calculation counts floor area across storeys under the ordinance's rules. This is not usable internal living space. Ask how porches, covered terraces, basements and ancillary buildings are treated. A basement is not automatically an uncounted allowance for extra accommodation.

Ocupación concerns building coverage, the horizontal projection relative to the plot. It is different from total floor area across the building's levels. A design can satisfy the floor-area limit while covering too much land. The applicable rules may also address overhangs and construction below ground; have the architect show the relevant calculations.

Limits that apply togetherPlot with a dashed setback envelope and a building footprint. Coverage, counted floor area and height must also be checked. This is not building consent.Limits that apply togetherDetached-building examplePlot · boundariesBuildingfootprintStreet · plot frontageDashed: setbacks in this exampleSchematic only, not to scaleOcupación · coverageHorizontal building projection. Not the sum of floor areas.Edificabilidad · floor-area limitNet area × net coefficient.Counted floor area; apply theordinance's counting rules. Also checkHeight, storeys, minimum plot size;plot frontage and shape;density and dwelling count. The house must satisfy all the limits. This drawing does not prove buildability.
Detached-building example, without scale or regulatory values. Setbacks on every side are not required by every ordinance. The footprint and dashed boundary do not establish permission to build.

How do setbacks and height affect the design?

Retranqueos and separaciones a linderos are setbacks and distances from boundaries. They govern the building's position. Establish the front, side and rear limits, and ask which part of the building is used for measurement. Where necessary obtain the alineación oficial, the official planning line: an existing wall or fence may not follow it.

Altura is height. An ordinance may restrict both height in metres and the number of storeys, and both then matter. On sloping ground the measurement reference can decide whether a design complies. Ask for a section drawing showing the relevant ground levels. Do not assume that filling the ground gives you another floor.

Is the minimum plot area enough to establish buildability?

No. Parcela mínima is a minimum-plot requirement, but you must also check any frontage and shape conditions. A narrow site may pass the area test and still leave too little room after applying the setbacks. The permitted floor-area ceiling does not promise that all of it will fit within the other limits.

Check the maximum number of dwellings and any density limit separately. Spare floor-area capacity does not itself allow you to split a house into independent homes. Ask the architect to identify the plan's dwelling limit as well as its minimum plot area.

Include existing buildings in the assessment. Ask the architect to account for their floor area and coverage and establish what works are allowed. Do not assume that demolition lets you rebuild the same volume. If buying a portion of a larger property, have the lawyer check the proposed division: article 26.2 of the TRLSRU requires resulting plots to meet the applicable law and plan. It also addresses certain undivided shares linked to exclusive use of a specific portion. An agricultural minimum subdivision area is a separate question from permission to build a home.

What should a written planning certificate cover?

Tie the request to the marked plot and intended works. Ask for the operative plan, land class and detailed designation. You need the ordinance and its calculation rules, not merely a statement that the land is residential.

Request confirmation of permitted use, floor area, coverage, setbacks, height, storeys, dwelling count, density and minimum plot dimensions. Also ask whether the land is a solar, a plot meeting the applicable conditions for building, and what planning or infrastructure steps remain. Ask about separate restrictions, licence suspensions and enforcement proceedings affecting it.

A short Spanish request you can adapt for the municipal procedure is:

There is no identical national validity period or legal effect for every document called a planning certificate.

In Andalusia, article 3 of the LISTA regulation requires the cédula to be sent within a month of entry in the municipal electronic register, unless the ordinance sets a shorter period. It is informative and non-binding. It remains effective while its underlying planning and management rules remain in force, for at most six months from issue. The absence of a reply does not confirm that your proposal is acceptable.

In Catalonia, the certificado de régimen urbanístico must be notified within a month of filing in the town hall's general register. For buildable land, its six-month validity runs from notification. Under TRLU article 105, the town hall must grant a licence properly applied for within that period, without irremediable defects, if the project meets the rules in force when the certificate was requested, in accordance with its contents. Separate sectoral laws still apply. This protection is not itself a licence. Paragraph 3 gives different effects for land that cannot obtain a licence directly; ask your lawyer which applies.

Can I use a declaration instead of applying for a licence?

The law determines the procedure. A licencia de obras is municipal building authorisation. A declaración responsable states that you meet the requirements and hold supporting documents; a comunicación previa is a notification for specified acts. Neither replaces a compulsory licence. Some regions allow the reverse choice: a voluntary licence for work eligible for a simpler route. Murcia provides this under LOTURM article 263.3; Canarias does so for notified work under article 332.3. Ask your architect which options apply.

A new home needs a technical project under the national Building Act, LOE, article 2.2.a. Its exemption for small, technically simple construction excludes residential and public uses. Calling a house small does not bring it within that exemption.

Declarations and notifications remain subject to checks. Essential falsehoods, inaccuracies or omissions can prevent the activity continuing, with the liabilities laid down in article 69 of Law 39/2015.

Have the assessment identify restrictions involving watercourses or flooding, coastal law, nature or heritage protection. Where affected, establish the responsible authority and required approval or report. Residential zoning does not settle these questions.

How do the regional procedures differ?

Use this comparison to frame your enquiry. The town hall still needs the location and scope of the actual works.

RegionWhat to establish
AndalucíaLISTA uses urban and rustic land classes. Prior licensing is the starting rule with statutory exceptions. Article 138 defines declaration procedures for small no-project works and specified interventions in existing buildings.
Comunitat ValencianaTRLOTUP article 232 requires a licence for new-build work. Article 233 lists declaration procedures for reforms and other acts; some require certification by an administrative certification body or professional college.
Región de MurciaMurcia’s planning law, LOTURM, articles 263 and 264, separates licensing and declaration. The small/simple new-building declaration exception is for non-residential, non-public buildings, not a new home.
CataluñaTRLU articles 187 and 187 bis distinguish licensing for new buildings and interventions requiring a project from prior notification for specified no-project works, subject to exceptions for location and protection.
Illes BalearsThe Balearic planning law, LUIB, articles 146 and 148, governs licensing and prior notification. Island councils can regulate scope within statutory limits, so check the island and municipal procedure.
CanariasLand Act articles 330 and 332 distinguish licensed new construction from specified notified reforms without added volume or buildability. Government decrees can change the lists: confirm the current procedure locally.

A prefabricated house does not bypass the use or consent enquiry. The Valencian, Catalan, Balearic and Canarian laws expressly address prefabricated homes in their licensing provisions. Confirm the proposed installation before placing an order with a supplier.

For rustic land, ask about planning authorisations needed before the licence. In Andalusia, actuaciones extraordinarias, exceptional rural development, require a separate prior authorisation; this includes isolated homes where the rules allow them. LISTA article 22 also provides for a municipal compensatory payment, prestación compensatoria. Clarify both before buying. Other regions have their own regimes: the rustic-land guide explains why calculating floor area alone cannot establish permission for a home.

Does an urban plot already have everything needed to build?

Ask whether it is a solar and, if not, what prevents that status. Andalusia's LISTA article 13.3, for example, requires infrastructure and services including sufficient water, wastewater and electricity capacity. A nearby pipe or power pole does not establish that the plot meets those conditions.

Request details of outstanding urbanisation works, land transfers and planning duties. Under TRLSRU article 27, the buyer succeeds to the owner's planning duties on the statutory terms.

Give your lawyer the deed and a recent nota simple, an informational Land Registry extract (Land Registry Act, article 222.5). Have them check the land and access rights against the deed, and identify registered planning charges or links to existing buildings. TRLSRU article 26.3 provides for recording indivisibility where building capacity is exhausted or the remaining plot would be too small. The absence of a Registry entry does not replace enquiries about municipal duties.

Also have the lawyer check easements and other private restrictions affecting the proposed layout. A licence does not override ownership or third-party rights (Local Corporations Services Regulation, article 12.1). A planning-compliant design can still be blocked by private rights.

What needs resolving before the deposit?

Before paying: who, cost and timing

  • Identify the plot and obtain current planning drawings and rulesYou and Urbanismo · document fee under local ordinance · request the municipal response period in writing
  • Obtain written planning information about the intended useTown hall · local fee · Andalusia: no more than a month; Catalonia: notification within a month, under the provisions explained above
  • Test the layout, calculations and existing buildingsIndependent architect · agreed quotation · agree timing from receipt of the complete documents
  • Compare deed and Registry extract with serviced-plot status, access, private rights and outstanding dutiesLawyer, town hall and architect · obtain document and professional quotations · resolve before committing to the price
  • Identify the consent route, prior planning authorisations and sectoral approvalsArchitect and relevant authorities · check each fee and commission · obtain the applicable deadlines for the actual case
  • Agree the purchase condition and refund mechanismYour lawyer · agreed legal fee · finalise before handing over a reservation payment

An arras contract is a private purchase agreement involving a deposit. Have your lawyer specify the intended use or project and the evidence required. Decide whether the condition requires favourable information, any necessary prior authorisation or the licence itself: favourable information can satisfy the first condition even if a licence is later refused. Agree a final date, extensions and repayment if the condition fails or no answer arrives. Requesting a certificate creates no automatic refund right. For an earlier reservation, have the recipient accept the repayment condition and separately agree what happens to any agency fee.

Do not pay the deposit yet if:

  • The only buildability evidence is an advert, property-tax receipt or Catastro screenshot.
  • Your home depends on an unapproved planning change or an unexplained licence suspension.
  • The architect cannot substantiate the intended use and a compliant layout.
  • Nobody can explain the remaining infrastructure duties and your exposure to their cost.
  • The certificate describes different land, or the seller refuses the purchase condition you need.
Already have a plot in mind?

Find it on the map, confirm the boundary and get the report as two PDFs (100 pages in English and 99 in Spanish in the sample report; the length of each order depends on the plot), with its sources and dates.

Frequently asked questions

How do I establish the exact permitted floor area?

Obtain the applicable ordinance and written planning information for the identified plot. The architect must check the calculation area, coefficient and counting rules alongside coverage, position and height. An advertised figure is insufficient.

Can I build if Catastro calls the land urbano?

That label does not grant consent. Cadastral classification follows its own legislation. Confirm the planning designation, use and conditions for building, including any outstanding urbanisation.

Does a planning certificate guarantee the building licence?

It is not the licence. Legal effects differ: the Andalusian cédula is informative; a Catalan certificate can protect a later application under the conditions in TRLU article 105. Check the document's contents, validity and applicable provision.

Can a small or prefabricated home avoid a technical project?

Small size alone does not exempt a new dwelling from the LOE project requirement. For a prefabricated home, establish the planning procedure and whether residential use is allowed. Do not order it on the strength of a supplier's advertising.

Can I extend a house already described in the deed?

The deed is not permission to extend. Obtain the planning history and have the architect establish the building's status, remaining capacity and permissible works. The same enquiry is needed to convert a store into a dwelling.
