Can I legally offer holiday lets in the Spanish home I want to buy?

14 min · Updated

In this article

You can offer holiday accommodation when that use is permitted at the property, the regional tourism requirements are met and any necessary owners' association approval has been obtained. Establish your position after the purchase before paying a deposit. The registration provisions of the state single-register scheme introduced in 2025 were annulled in 2026; regional and municipal controls remain.

An existing holiday listing does not establish your right to operate after buying. Check local planning, the regional tourism file and any owners' association, with a separate review for rural accommodation.

What permission would you actually be buying?

Vivienda de uso turístico, usually VUT, means a tourist home under regional rules, rather than one national licence category. A casa rural is separately regulated rural accommodation, not a marketing description for any country house.

Send the town hall and regional tourism authority the cadastral reference, Land Registry identification and a plan. Describe the intended operation: whole-home or room bookings, guest capacity, operating periods and any conversion work. Ask which category and permissions would apply to you as the new owner.

A due-diligence order before committing your deposit, rather than one national application procedure. The checks accumulate. Owners' association requirements depend on the property and the applicable civil law.

A declaración responsable is a signed declaration of compliance. You state that the requirements are met, supporting documents are held and compliance will continue. It is not evidence that an official has already inspected and approved everything. Essential false statements or missing evidence can prevent continued operation (Law 39/2015, article 69).

Request a municipal assessment of tourist use at this address, including current restrictions, suspended applications and enforcement affecting the property. An information letter does not replace a required permission. If renovation is part of your plan, also establish what the planning rules allow.

What happened to the national rental register introduced in 2025?

The provisions of RD 1312/2024 requiring that state rental number were annulled. RD 1312/2024 entered into force on 2 January 2025 and took effect on 1 July 2025. Its original scheme required a number from the Registro de la Propiedad, the Property Registry, or the Movable Property Registry to advertise covered tourist and other short lets online. It did not replace regional tourism permission.

The Supreme Court judgment of 19 May 2026, published in the BOE on 8 June, annulled the registration procedure and the associated obligation to obtain that number. The consolidated decree marks articles 5 and 8 to 10, among others, as annulled and records subsequent judgments to the same effect.

The Ventanilla Única Digital, the national gateway for exchanging rental data, was not abolished wholesale. The Ley de Arrendamientos Urbanos (Urban Leases Act, LAU) also regulates platform information duties. Data exchange and the annulled registration route must be distinguished.

Keep an old NRA or NRUA, the labels used for the state rental number, with the seller's documents. Do not treat it as a transferable national licence worth an additional purchase premium. Ask the regional authority and your intended platform which identifier currently applies to this particular unit.

Can the owners' association stop holiday letting?

A comunidad de propietarios is the association governing shared property under horizontal ownership. For communities governed by the state Ley de Propiedad Horizontal, LPH, express prior approval has been required for owners wishing to start the relevant tourist activity since 3 April 2025 (article 7.3). Silence in the statutes does not amount to approval. Nor does an agent pointing to another apartment that hosts guests.

Article 17.12 requires favourable votes from three fifths of all owners, representing three fifths of all ownership quotas, to approve, restrict, impose conditions on or prohibit the activity. The quotas are the ownership shares used for community decisions and expenses. Counting only those attending a meeting is insufficient. Obtain the statutes and a certificate of the resolution, including the voting shares. Have your lawyer compare them with the registered deed and statutes for the shared-property development and assess which restrictions bind you as buyer. The lawyer should also check notification of absent owners and the final vote count where applicable (articles 5 and 17.8).

The same majority may agree special charges or an increase in the tourist property's participation in common expenses, capped at 20%. This is not an automatic surcharge and is not a percentage of booking revenue. These resolutions do not have retrospective effect.

The second additional provision protects an owner already operating before 3 April 2025 who had previously complied with the tourism regime, subject to its conditions and time limits. An old registration date alone does not demonstrate both requirements. Your lawyer must assess whether the seller qualifies and what the purchase changes, including the regional rules on a new owner.

Catalonia has its own civil property rules. Do not automatically apply the state approval formula there. Amendments to the title or statutes generally require four fifths of owners entitled to vote and four fifths of quotas, unless another legal rule applies (article 553-26.2.a). Have a lawyer assess the particular restriction and its effect on a buyer under the Catalan Code.

Which regional differences affect a buying decision?

Andalucía: which rural accommodation category applies?

Decreto 28/2016 refers homes in the medio rural, the legally defined rural setting, to rural accommodation rules. There is an express exception: article 9.3 of Decreto 20/2002 permits a VUT where the accommodation does not meet the requirements for viviendas turísticas de alojamiento rural. It then follows Decreto 28/2016 and cannot be marketed as rural accommodation. Planning requirements still apply.

Ask Tourism whether the building qualifies as vivienda turística de alojamiento rural, casa rural or VUT.

For a VUT covered by the decree, the operator files an electronic declaration addressing planning compatibility, capacity, operating periods and applicable community approval. Town halls can impose proportionate limits by building or area. Missing permissions or loss of qualifying conditions can lead to cancellation.

Asimilado a fuera de ordenación, AFO, is a recognised status for certain irregular buildings. It does not itself authorise tourist letting. Under the VUT rule, express prior municipal authorisation for the activity change is required. That provision does not resolve a separate rural category or legalise building work. Read the guide to irregular houses on rustic land before pricing such a property as an operating business.

Comunitat Valenciana: does the seller's registration continue?

Article 65 of Law 15/2018 defines the VUT as a whole home provided for tourist purposes for no more than 10 consecutive days to the same tenant. Tourist room letting within this category is prohibited. A favourable municipal tourist-use compatibility report, or equivalent, is required, together with other applicable municipal permissions.

Registration generally lasts five years, subject to legal exceptions and the property's transitional position. On a change of ownership, a fresh declaration and the favourable municipal report or equivalent must be supplied under the requirements then in force. The seller's earlier operating conditions are therefore not something to assume you inherit.

Extending a booking beyond the regional VUT definition does not automatically create a lawful temporary-housing tenancy. The actual reason for the letting and the current state tenancy rules still need examination.

Región de Murcia: is the tourism classification final?

The Instituto de Turismo de la Región de Murcia, ITREM, handles VUT commencement, changes and cessation through its declaration procedure. The official procedure allows activity to start after correct registration and notification of a provisional signatura, the tourism identifier, provided all other requirements are met. Inspection and final classification follow; non-compliance can lead to refusal and cancellation of the number. Obtain the current file, including any inspection result.

The procedure covers whole homes and bedrooms, unlike Valencia's room prohibition. It also addresses community approval where applicable. For a country property, ask ITREM to identify the category and obtain the town hall's land-use assessment separately.

Cataluña: what does an HUT entry establish?

HUT stands for habitatge d'ús turístic, the Catalan tourist-home category. The municipal procedure to start the activity is handled through Canal Empresa. The town hall checks the information and sends the data for tourism registration; local suspensions and restrictions still need checking.

Municipalities covered by Decreto-ley 3/2023 require prior planning permission, lasting five years, renewable for equal periods where the plan allows. Homes already lawfully authorised in those municipalities when the decree took effect are subject to a transition: obtain the new planning licence within the ordinary period ending 9 November 2028, or cease, subject to the individual extension permitted by law.

This does not guarantee operation until that date or later renewal. Ask the town hall which route applies to the address and existing file.

Illes Balears: are the zone and tourism places available?

Ask the consell insular, the island council, about suitable zoning, tourism places and habitability documents. Tourism places are the authorised guest capacity; check whether the places needed for your operation are available. The DRIAT, declaration starting a tourist activity, does not remove those requirements. A detached house is not automatically eligible for new places.

Check sanctions as well. A final serious or very serious planning sanction prevents tourist marketing until planning legality is restored. For a home subject to a final sanction, a change of the registered tourism operator cannot be approved until the debt to the sanctioning tourism authority is settled (Law 8/2012, article 50.4). Obtain payment evidence. This does not mean all the seller's debts automatically become yours.

Decreto-ley 4/2025 prohibits new declarations for homes under horizontal ownership, with exceptions for terraced and semi-detached homes and principal-home letting. The latter covers the owner’s main residence and permits no more than 60 days a year (article 50.20). Existing operations are not all closed by this ban.

Where the time-limited rules for horizontal-ownership or principal-home files apply, permission lasts five years by default, unless implementing rules set another term (articles 50.3 and 50.20). Check the expiry date, extension notification and evidence of tourism places for the next period where applicable. Renewal requires continuing compliance and suitable zoning.

New holiday letting on protected rustic land is generally prohibited. Island PIAT or PTI planning instruments may make reasoned alternative provisions. Obtain the applicable map and rule for the parcel.

For a new operation, establish the required building age and its private residential use during that period. Unless implementing rules set a different requirement, the minimum is five years (article 50.17). Lawful completion of a new house is insufficient.

Canarias: can you acquire the seller's established status?

Law 6/2025, amended in August 2026, distinguishes residential use from tourist accommodation. For a new application under the main rules, residential zoning alone is insufficient: the plan must allow tourist use and a declaration must be filed with the cabildo, the island authority. Tourism registration does not validate breaches.

That route requires a home at least ten years old, or five in El Hierro, La Gomera, La Palma and municipalities designated as facing demographic challenges. The plan may reduce the age requirement for the housing types it specifies if its area is not subject to a declared stressed residential market zone (article 5.1.a). Confirm the applicable age rule and evidence with the town hall.

The ordinary declaration permits operation for five years, or ten on those islands and in those municipalities (article 10). To continue, file a fresh declaration in the month before expiry, meet the requirements then in force and obtain a favourable municipal certificate. Transitional operations need separate review.

Distinguish a new authorisation from transitional operation and uso turístico consolidado, consolidated tourist-use status. Consolidated status generally ends when ownership is transferred, with a specific exception for certain inheritances. Ask the town hall and cabildo what you could continue after buying, rather than accepting the seller's status as transferable.

For specified earlier files with a tourism declaration but no municipal classified-activity notification, the amendment allows that notification before 31 July 2027, with the required evidence. It is a conditional route for those files, not a universal deadline for all holiday homes.

The general regime restricts enabling tourist housing in agricultural settlements and certain protected rustic categories. El Hierro, La Gomera and La Palma retain special-law differences. A conclusion reached for a property on another island should not be applied to them without checking.

Does a rural location allow construction followed by registration?

Tourism registration does not authorise a new house, rebuilding a ruin or using an agricultural store as guest bedrooms. The state Land Act makes use subject to planning and land protection, and building works need the applicable administrative approval.

Have an architect compare the physical house, annexes and pool with what was authorised. A cadastral entry, an electricity supply or previous guests do not establish authorised tourist use. Ask the architect to identify the requirements affecting access, water, sewage and safety, and permissions for intended alterations. In Illes Balears and Canarias, also check the minimum energy rating and applicable exceptions: holding a certificate alone is insufficient.

What should be resolved before paying the deposit?

Checks before committing to the purchase

  • Exact tourist use, local restrictions and permissions for worksTown hall and architect · ask for office charges and a quote · obtain processing times before setting the deposit deadline
  • Correct category, validity and change-of-owner routeRegional Tourism or cabildo · confirm applicable charges · establish validity and sequence before signing
  • Statutes, resolutions and required approval for this propertyAdministrator and your own lawyer · obtain a quote · finish review before paying
  • Building legality, occupation documents and necessary adaptationsArchitect and town hall · obtain review and works budgets · establish permissions before promising dates
  • Refund conditions and an operating budgetLawyer and relevant professionals · itemised fees and costs · agree before any reservation payment or deposit

Obtain separate prices for the legal review, necessary adaptations and tourism places where relevant. Include insurance and operating costs in your income calculation. The filing date of a declaration does not mean inspections are finished or building work has been authorised.

Arras is a purchase deposit, usually documented in a contrato de arras, the deposit agreement. If rental income is essential, negotiate a specific condition in both the reservation and deposit documents. Lawful conditions can be agreed under Civil Code article 1255; writing “tourist licence” does not automatically give you a refund entitlement. See the guide to arras and recovering a deposit.

Do not pay an unprotected deposit yet if:

  • The seller supplies only a listing screenshot or an old state rental number.
  • Tourist-use compatibility or an applicable municipal suspension is unresolved.
  • Required community approval is missing or a prohibition has not been assessed.
  • Continuation depends on the seller's personal status that ends on sale.
  • Proposed bedrooms occupy unauthorised annexes, or the rural category remains unsettled.

Frequently asked questions

Does the seller's tourism number automatically pass to me?

Do not assume it does. Obtain the file and the authority's requirements for the purchase. In the Comunitat Valenciana, a new owner must submit a fresh declaration and favourable municipal report or equivalent. In Canarias, consolidated tourist status has transfer-related termination rules that need review before you value the business.

Can the association prohibit letting despite tourism registration?

Under the state LPH, approval, restrictions, conditions and prohibition use the double three-fifths majority. Tourism registration does not replace required community approval. Earlier operations need a separate assessment, and Catalan communities must be considered under their own Civil Code.

Should I apply now for the NRA under RD 1312/2024?

The provisions imposing that state procedure were annulled in 2026. Do not treat older application instructions as current law. Ask Tourism and the platform which identifier applies. Annulment does not remove regional operating requirements or municipal controls.

Can I avoid tourism rules by calling bookings seasonal lets?

No. Since 8 October 2026, the LAU requires the contract to state a real, provable reason for the tenant's temporary move. The landlord bears the burden of proof. Without the required contractual reason, standard residential tenancy protections apply from the date of signing (articles 2.3 and 7.2). Its article 5.e caps the tourist letting it describes at 31 days; shorter regional limits still apply. A different contract label does not avoid these rules.

Can an irregular house be registered as a casa rural?

Tourism registration does not legalise the building. Establish the rural category and the planning permissions for the house, annexes and proposed use. A declaration of compliance does not remove breaches or prevent later inspection.
