What needs organising before you pay a deposit?
Before paying a reservation or purchase deposit, ask your own lawyer to check whether each buyer can obtain their NIE and release the funds by the proposed signing date. If someone will sign for you, have their authority checked too. Review these arrangements alongside the property checks before accepting the seller's deadline.
The pre-purchase checklist covers the property checks. The arras guide explains the purchase-deposit agreement and the conditions to negotiate. The Spanish term arras refers to the deposit arrangement; do not assume a delay in obtaining your number or moving money automatically entitles you to a refund.
If you are not an EU national, have your lawyer check whether the property requires military authorisation because it lies in a restricted acquisition zone. Where required, permission must be evidenced before signing. Exclusions and an exemption for individual EU nationals apply (Ley 8/1975, articles 16, 18 and 20 and its additional provision).
For an acquisition subject to that regime, also require proof of completed registration. Article 21 makes the transaction void if not registered within 18 months of the deed. This extends to 24 months where tax assessment or another formality prevents registration without the buyer's fault. Have your conveyancer track it well before expiry.
Is an NIE a residence permit or a tax number?
An NIE, Número de Identidad de Extranjero, is the personal identification number assigned to a foreign person dealing with Spain. It is unique to you. Tell your adviser if you already have one from an earlier transaction. It does not grant immigration permission, and the certificate alone does not replace your passport or other accepted photographic identification.
For a foreign individual, the NIE normally serves as the NIF, the Spanish tax identification number. Exceptional tax-issued identifiers exist, but arrange the ordinary NIE route unless the notary confirms an appropriate alternative for your circumstances. Do not rely on the estate agent's statement that your passport will be enough for everything.
The notary must record the parties' tax identification, including that of anyone represented by somebody else (Notaries Act, article 23). Missing tax numbers prevent Land Registry registration until corrected. This is why the absent joint buyer's documents matter as much as those of the person attending. Send copies early and check spelling, full names and the ownership names intended for the deed.
Tell the notary your marital status and marital property regime, even if buying alone. Send any marriage agreement and ask which supporting documents are needed (Notarial Regulation, article 159). Who provides the money does not by itself establish the ownership shares to record.
How do you apply, and what does it cost?
In Spain, the application goes through the Police or an Extranjería office, the immigration administration. If applying from abroad, use the Spanish consular channel for your place of residence. The published police procedure names form EX-15 and fee form 790, code 012. Interior requires the original and copy of your complete valid passport or accepted identity document, the completed and signed application and an explanation of the economic or other reason for applying. Applicants must not be irregularly present in Spain.
The police tariff checked for this guide charges €9.84 for assigning an NIE on request. That is not a quote for an intermediary's service or the consulate's payment arrangements. Ask the consulate what applies there; obtain a separate written quote if somebody handles the application for you. The police procedure allows payment at the listed financial institutions without opening an account with them.
The published decision and notification period is five working days from the application reaching the competent body's register, excluding Saturdays, Sundays and public holidays. It does not cover the entire journey from seeking an appointment abroad to receiving the result. Establish the appointment and delivery arrangements before agreeing a completion deadline. A representative applying for you needs express authority to request the NIE; a power intended solely for purchasing may need different wording.
Can you use your existing foreign bank account?
The Spanish rules governing identification and recording purchase payments do not themselves require a Spanish account. You can arrange a payment from abroad where the route is documented and the chosen method is agreed. For euro transfers and direct debits covered by the European payments regulation, a reachable EU account cannot be required to be in a particular Member State. This is not a promise about every account outside the EU or every bank-cheque service.
Before opening a local account, compare maintenance, payment and currency-conversion charges. If borrowing, confirm your lender's account and drawdown requirements before moving the funds.
Give the bank a clear explanation of the incoming funds. Depending on your circumstances, documents about a property sale, inheritance or accumulated savings may explain the source; account statements help connect that source to the money you will use. Ask which documents and language the bank accepts. Its checks are not limited to confirming a balance or seeing your NIE.
Ask what evidence of non-residence the bank requires for that account.
What must the escritura say about the purchase money?
The escritura pública is the public deed signed before the notary. Its payment record covers money paid earlier as well as money delivered at completion (Notaries Act, article 24). A reservation or arras payment credited towards the price belongs in that record. Keep a separate agency charge distinct from money paid on account of the property.
Give the notary a schedule reconciling the full price with each instalment: date, amount, recipient and payment method, backed by evidence. For transfers, provide the ordering party and beneficiary, sending and receiving banks and the debit and credit accounts. If a currency provider sits between your savings account and the seller, obtain evidence connecting its transfer to your purchase.
Article 177 of the Notarial Regulation sets out identification requirements and the essential details that can suffice even where account codes are unavailable. Let the notary assess a documentary gap before completion. Do not assume that a screenshot saying “sent” identifies the payment adequately.
If using a cheque bancario, a bank cheque issued by the bank, agree the payee's exact details before ordering it. The funding account also needs identifying, and the notary incorporates evidence of cheques handed over at signing. Supply information about earlier cheque payments too.
Refusing to identify how the price was paid can prevent registration even if the deed has been signed (Land Registry Act, article 254). A statement that the seller has received the money does not remove the identification requirement. Check that the draft accounts for the full price. If new bank details arrive by email, verify them through an established contact before paying.
How can someone sign for you while you remain abroad?
A poder notarial is a power of attorney: it authorises an apoderado, your appointed representative, to act within its terms. Have the Spanish purchase notary review the proposed wording before you sign it. A private letter authorising someone to collect documents is not suitable preparation for executing the purchase deed.
You can arrange a power with a Spanish notary or enquire about a Spanish consul exercising notarial functions. For a power made abroad, the Spanish notary must check its formal validity and the authority it grants, and whether the foreign official performed a function equivalent to a Spanish notary's, rather than merely witnessing a signature. Ask the Spanish notary which apostille or legalisation and translation requirements apply. An apostille alone does not make inadequate powers sufficient.
Set boundaries that fit your instructions: the property, maximum price, payments and authority to complete and handle taxes. Include applying for an NIE or dealing with the bank if necessary. If borrowing, have mortgage powers checked separately. Also ask what any substitution or conflict-of-interest wording would allow. You need to know who could act and whose interests they could represent.
Ask for the cost and delivery date of the power, its authorised copy and any required translation or legalisation. A mandate can be revoked under Civil Code article 1733; ask how to formalise revocation and notify those concerned. If you attend but cannot sufficiently understand the document language, arrange the notary's oral translation or an interpreter under Notarial Regulation article 150.
Does a holiday home create tax even without rent?
First establish your tax residence. Owning a house, holding an NIE or opening an account does not decide it. Spanish domestic rules include spending more than 183 days in a calendar year or having your main centre of economic interests in Spain, alongside absence rules and a rebuttable family presumption. Where two countries could regard you as resident, the applicable treaty also needs checking (Income Tax Act, article 9).
For an individual who remains non-resident, an urban home kept available for personal use or left empty can generate renta inmobiliaria imputada, imputed property income. You pay IRNR, Impuesto sobre la Renta de no Residentes (non-resident income tax), on a calculated amount even though no tenant pays you. Modelo 210 is the self-assessment form. IBI is a separate municipal charge; a direct debit for IBI does not file your non-resident return.
What is the calculation for the 2026 income year?
Start with valor catastral, the cadastral value found in the IBI documentation. This is not the purchase price or the separate valor de referencia, the reference value used for other tax purposes. For 2026, the general imputation percentage is 2%. The 1.1% percentage applies where a municipality's general collective cadastral valuation took effect from 1 January 2012. The October amendment expressly extends that rule to 2026 in additional provision fifty-five of the Income Tax Act. Ask your adviser to confirm the effective date of the general valuation with Catastro, Spain's cadastral authority, and keep the evidence. Your purchase date or an individual record update does not establish eligibility.
If, on 31 December, the property has no cadastral value or it has not been notified to the owner, compare the acquisition price or value with the value checked by the tax administration for other taxes. For 2026, imputed income is 1.1% of half the higher amount. A missing IBI bill is a reason to check which rule applies, not to skip the return.
Adjust for your ownership period, the days the property was available rather than rented, and your ownership share. Availability is not limited to the days of your visits. Mortgage interest, insurance and IBI do not reduce this imputed base. Rental income has different rules; do not copy this treatment into a rental calculation.
Apply the general non-resident income-tax rate to that base: 19% for tax residents of the EU, Iceland, Norway and Liechtenstein, and 24% for other taxpayers under the domestic rule. The distinction concerns tax residence, not the passport you hold. For example, UK tax residence falls in the latter group under that rule.
What if you buy bare land or a rural building?
Undeveloped land is excluded from this imputation. Property under construction or unusable for planning reasons also has an exclusion; merely intending to renovate does not establish that condition. Ask your adviser what evidence supports the position for the property you buy.
For a rural house, seek a written assessment rather than accepting “rustic means no tax”. Article 85 mentions rural buildings not indispensable to farming, livestock or forestry, while the IRNR charging rule expressly refers to urban property. Have the adviser resolve the classification and treatment of the actual house. A usufruct, a right to enjoy the property, also changes who accounts for imputed income.
When is Modelo 210 due, and who should file it?
Imputed income accrues on 31 December. For 2026 income, file and pay between 1 April and 31 December 2027. The published direct-debit window ends on 23 December 2027. Imputed income from 2025 retains its filing window during 2026. The income year and the year in which you submit the return are different.
Identify each owner and each property separately; annual imputation is not a joint household return. The amended form asks for the number of days and your ownership share for submissions from 2027. Keep a record of use if the property is rented for part of the year: actual rental income and the remaining available days need separate treatment, and rental income has its own filing timetable.
Instruct someone expressly to prepare the first return, or arrange to file it yourself. Ask what proof of submission and payment you will receive. The lawyer who completed the purchase is not automatically engaged to file future returns. A foreign owner does not always need a tax representative. However, if your residence jurisdiction has no effective tax information exchange, owning Spanish assets requires an appointment. Have your adviser check your jurisdiction, the other statutory cases and any tax-authority requirement under IRNR article 10.
These are state rules for Andalucía, Comunitat Valenciana, Región de Murcia, Cataluña, Illes Balears and Canarias, rather than regional purchase-tax rates. For property in the Basque Country or Navarra, check which tax administration is competent under their separate tax arrangements. Use the purchase-cost guide for acquisition taxes.
What should be confirmed before paying arras?
Agree responsibility, price and timing
- Identity, NIE and marital property regimeYou, lawyer and notary · €9.84 police assignment fee plus agreed charges · before the contractual deadline
- Source of funds and completion paymentYou and the bank · written currency, transfer or cheque quote · confirmed availability date
- Payments and non-resident seller obligationsLawyer and notary · calculate withholding and any municipal plusvalía · before instructing the balance
- Power and translation, where neededPurchase notary and issuing professional · quote for copy and formalities · prior review and agreed delivery date
- Registration and first post-purchase returnLawyer and tax adviser · written quote · registration evidence and Modelo 210 calendar separate from IBI
Do not pay the deposit yet if:
- there is no workable identification timetable and no agreed contractual protection;
- the bank is still requesting documents and nobody confirms when payment can proceed;
- the instalments do not reconcile with the deed price;
- the Spanish notary has not checked the foreign power, or required military authorisation remains outstanding;
- you are being asked to leave the consequences of identification or payment delays until after paying.
Have your lawyer negotiate the deadline, extension and any refund conditions in writing. A bank delay or an NIE application delay is not, by itself, a guarantee that your deposit will come back.
