What exactly are you buying the right to do?
Establish whether the remains can become the home you need. Restoring a house, converting an agricultural building and replacing a ruin are different planning questions, even if the advert calls them all renovation.
Spain's national land law requires the administrative approval prescribed for the work. Silence cannot create rights contrary to planning law (TRLSRU, article 11.3). A friendly conversation about restoring old houses is therefore a poor basis for committing your deposit.
Ask your architect what can stay and what must be rebuilt. The town hall needs to identify a legal route for those works and residential use. Permission merely to maintain the shell is insufficient if you need structural replacement.
If the land classification itself is unclear, first read about rustic and urban land in Spain. Suelo rústico or suelo no urbanizable means land subject to the relevant rural or non-developable planning regime. Existing buildings can have their own rehabilitation routes, but do not remove the land's planning and protection constraints (TRLSRU, article 13.1).
Does a house on the official records carry rebuilding rights?
Check which record the agent means. The Catastro is the cadastral database, recording location, area, use and other property characteristics. Its description is not a municipal building permission (Cadastre Act, TRLCI, article 3). A cadastral outline labelled as residential does not establish that the present shell was authorised as a dwelling.
The Registro de la Propiedad is the Land Registry. National law allows certain old buildings to be recorded when planning enforcement measures requiring demolition are no longer available, subject to the statutory checks and evidence. This route, under TRLSRU, article 28.4, does not authorise recreating a lost building. Request the deed recording the building and find out whether registration relied on age evidence. Your lawyer should compare it with the municipal planning position, including any later notification or marginal note.
A certificado de antigüedad, a technical certificate of age, helps establish a chronology. It does not by itself prove lawful residential use or that enforcement powers have expired for every part. A later extension or change needs its own examination. Some circumstances fall outside the ordinary enforcement time limit: Andalucía's LISTA, article 153, includes public domain, certain protective easements and specified continuing hazards.
Compare each structure's approved plans, licences and completion evidence with the measured remains and historic imagery. Resolve any mismatch between a deed describing a home and a licence for agricultural storage before committing money.
If the seller supplies a reconstruction licence, get a copy. Ask the town hall to confirm its validity, scope, remaining deadlines and any steps needed if you take over the project. Check that it covers the remains as they stand now.
When does repairing a ruin become reconstructing it?
There is no national rule giving every owner permission to rebuild once a wall has been retained. The assessment needs a measured survey and a description of the surviving structure, damage and proposed replacement. Ask the architect whether there is reliable evidence of the original form and volume, rather than assuming the registry description settles both.
Ask the town hall to classify the intervention: reparación, repairs; consolidación, structural strengthening; rehabilitación, rehabilitation; reconstrucción, reconstruction; or sustitución, replacement. A roof repair may involve rebuilding its supporting structure. The written answer must address the actual work.
Use is a separate question. Restoring an agricultural store is not permission to live in it. Specify your intended residential use and ask which parts may serve it. A residential answer should not be read as approval for a tourist business. If missing permissions are the main issue, use the guide to unlicensed rural houses alongside this one.
How do the regional rules change the answer?
Fuera de ordenación is a planning status restricting works or use. Its scope depends on the region and the reason for the designation. A building lawfully erected before a new plan can become nonconforming; some regional laws also use the term for unlawful buildings where action to restore planning legality is no longer possible. Ask your lawyer to identify the exact category and provision. An assurance that the building is “too old for enforcement” leaves the rebuilding question unanswered.
Andalucía: what does an AFO decision allow?
The LISTA treats lawful buildings made inconsistent by a later plan under article 84. The plan sets the works regime, with statutory default rules where it does not specify one. This differs from asimilado a fuera de ordenación, usually shortened to AFO: the recognised status of qualifying completed irregular buildings under articles 173 and 174.
Check another possibility for older ruins. Transitional provision five gives certain buildings completed before Ley 19/1975 took effect, without a licence for their location on non-developable land, the same regime as buildings with works and occupation or use licences. This covers the use at that time, excluding later unlicensed alterations. Request the municipal certificate of the applicable regime; it is not reconstruction permission. In maritime-terrestrial public land and its easements, coastal legislation governs instead.
AFO does not legalise the building. After recognition, licences can authorise maintenance and alterations, including structural strengthening without increasing footprint or volume, with an exception for certain auxiliary elements required by sectoral rules. Compatible use changes may also be authorised. This is not general permission to replace a ruin.
Before recognition, works and access to basic services are prohibited, except safety and health works ordered by the town hall. A roofless shell may not meet recognition requirements. For a requested AFO decision, the statutory maximum is six months and silence means rejection. Obtain the decision, drawings, conditions and registry marginal note. Utility connections depend on the statutory conditions and the companies confirming feasibility.
Comunitat Valenciana: is there a traditional-building route?
The TRLOTUP, article 206, distinguishes buildings fuera de ordenación, where only maintenance is allowed, from buildings that do not fully comply with the plan but fall under its transitional rules. In the latter, alterations must not worsen noncompliance or completely reconstruct elements that breach the plan. Under article 256, expiry of the enforcement period does not legalise unlawful construction. While the breach persists, the unlawfully built part cannot be altered, enlarged or structurally strengthened.
A different provision, article 231 bis, concerns traditional rural settlements and isolated vernacular buildings predating the entry into force of Ley 19/1975. A territorial or planning instrument must identify and regulate them, specify permitted uses and set recovery conditions. Municipal licensing is required. Request the instrument covering this building and its conditions; an old date in the cadastral database does not establish access to this route.
Región de Murcia: why distinguish fuera de norma?
Murcia's LOTURM, article 112, restricts works on buildings fuera de ordenación, including increased volume and modernisation, while allowing repairs to maintain the legitimately established activity. The plan identifies the relevant cases and tolerances.
Fuera de norma is a separate category for less severe noncompliance. The appropriate procedure may permit improvements, alterations or enlargement that do not worsen it. Obtain the town hall's classification and its application to your project. The label does not itself establish a right to replace the whole building.
Cataluña: what does the rural-building catalogue say?
The TRLU, articles 47 and 50, provides routes for recovering certain buildings on non-developable land. For the residential route discussed here, establish that the building is a masía, a traditional farmhouse, or casa rural, a rural house. Request its entry in the planning catalogue and read the permitted use and works conditions. Not every old agricultural building qualifies as a house.
Article 50 bis requires respect for the pre-existing volume and original composition. Partial replacement or enlargement must be necessary for a permitted use, significantly improve preservation and keep the retained original volume dominant. If the plan does not sufficiently detail partial replacement or enlargement without a separate building volume, the territorial planning commission must report; an adverse report is binding (article 50.3).
Where the municipality has not yet catalogued its rural buildings, transitional provision fifteen allows the article 48 procedure, with specific justification for preservation or recovery. This differs from omission from an existing catalogue. Article 108 also distinguishes fuera de ordenación from volumen disconforme, a nonconforming building volume with a different works regime.
Illes Balears: which status or legalisation route applies?
The LUIB, article 129, separates inadecuada, a lawfully established building inconsistent with a subsequent plan, from several categories of fuera de ordenación. The former can admit specified rehabilitation and consolidation. Unlicensed buildings no longer subject to restoration requiring demolition have a much narrower ordinary works regime. Where an otherwise lawful house has an illegal extension, establish the status of each part.
Additional provision seven of Ley 7/2024 allows extraordinary legalisation through a technical project and municipal licence. Enforcement requiring restoration must no longer be available when applying. The application must cover all works and uses in fuera de ordenación in the same property unit, either legalising them or combining legalisation with the required demolition. Exclusions include public land and the flood or flood-risk zones specified in the provision.
The project must include wastewater treatment complying with the Balearic hydrological plan. Obtain the municipal council's resolutions too: these can require changes to appearance, reduced light pollution and energy or water savings, and exclude activities or uses from this procedure. Price the required works; failing to meet these conditions can lead to refusal.
Applications have a three-year window from publication in the BOIB, the Balearic official gazette, of the island council's implementation agreement. Beyond taxes and fees, the contribution is 10% in the first year, 12.5% in the second and 15% in the third. The base is the construction cost of what is being legalised (coste de ejecución material), valued at the application date, rather than the purchase price. Qualifying Spanish personal-income-tax payers can obtain income-based reductions. Request the agreement and an individual calculation.
The legalised activity is tied to the full area of the cadastral parcels forming the registered property. It cannot be subdivided while that activity continues unless the land exceeds the required minimum and the appropriate prior release procedure is completed. Check this if you intend to sell part.
A dwelling's legalisation licence must prohibit marketing tourist stays. The condition and building legalisation must be entered in the Land Registry within three months; check the entry if the seller already has the licence. Have any claimed exception under transitional provision four checked. A pending application does not authorise reconstruction.
Canarias: can ethnographic value support reconstruction?
Ley 4/2017 distinguishes situación legal de consolidación, the status of certain lawful buildings inconsistent with a later plan, under articles 159 and 160, from unlawful buildings fuera de ordenación under article 362. Different works are allowed in each case.
Article 161 provides a particular authorisation route for buildings with age-related ethnographic value that are manifest ruins or require prior demolition of more than 50% of their structural elements for rehabilitation. A technical project must establish the circumstances and preserve the materials, type and appearance associated with the original values. The provision also extends to qualifying buildings fuera de ordenación. Ask your architect to demonstrate the case. An agent's description of a “traditional house” is insufficient.
Is a formal declaration of ruin permission to start again?
A physical ruin and a municipal declaración de ruina, a formal ruin decision, are different matters. Request any decision and establish what it orders, whom it was notified to and what remains outstanding. Safety measures may affect the money you need immediately after purchase.
The decision itself does not grant rebuilding rights. In Andalucía, LISTA, article 146, provides for demolition where the building's regime does not permit rehabilitation. Cataluña's TRLU, article 198, also distinguishes according to whether rehabilitation is permitted and whether the building has protected status. For a protected building, check the specific safeguards and competent authority's decision before treating a ruin declaration as demolition permission.
Buying does not remove the owner's planning duties (TRLSRU, article 27). Have your lawyer examine outstanding orders against both the municipal file and registry information.
What should the town hall confirm in writing before you commit?
Submit through the municipal document registry or electronic office. Identify the cadastral reference and registered property; attach the architect's survey and works description. You can use this Spanish request, asking for the building's status, permitted works and use, required approvals and outstanding orders:
«Solicito informe sobre la edificación identificada en el plano adjunto y las obras descritas en la memoria. Indiquen su situación urbanística, el planeamiento y los preceptos aplicables; si se admite reconstruir los elementos señalados y destinar el resultado a vivienda; qué volumen y superficie se reconocen; y qué licencias, autorizaciones previas y documentos de ocupación procederían. Indiquen protección patrimonial, afecciones y expedientes u órdenes pendientes que consten, así como los efectos de desmontar los elementos identificados.»
The request also asks which floor area and building volume are recognised, what occupation documents would be needed, which heritage or other restrictions apply, and how dismantling the identified parts would affect permission to replace them.
Arrange the seller's cooperation if needed for access to the file. Seek clarification if the reply addresses only the land, rather than the building and proposed replacement. Information is not project approval. Where buying depends on rebuilding, negotiate a condition requiring approval of the specified project.
Checks before paying the purchase deposit
- Match deeds, registry information, cadastral outline and permissions for every structureYour lawyer and seller · agree the review fee · complete before committing the deposit
- Record what survives and what must be replacedIndependent architect · written quotation · agree delivery before signing arras
- Obtain a project-specific answer on status, residential use and worksTown hall and architect · ask the local fee · confirm response time and resolve feasibility before committing
- Examine any AFO, catalogue entry, legalisation, ruin decision or outstanding orderLawyer and competent authority · quote review and required measures · settle before fixing the purchase budget
- Check access and written water, wastewater and electricity arrangements for the projectArchitect and suppliers · quote connections and works · confirm terms before paying arras
- Agree the required result, deadline and refund of reservation or deposit moneyYour lawyer and both parties · agreed drafting fee · sign before any payment
Read the guide to arras and reservation payments before signing. The condition should name the required result, whether sufficient written advice or an actual licence, and annex the intended use and works. Agree what happens if the response is adverse, qualified, incomplete or absent; provide a deadline, any extension mechanism and repayment terms (Civil Code, article 1255). Address agency-held payments and obtain agreement from whoever must refund them.
Discovering that your project is impossible does not automatically return the deposit. Where arras penitenciales, a deposit carrying an agreed withdrawal right, are expressly chosen, a withdrawing buyer loses the deposit and a withdrawing seller returns double (Civil Code, article 1454). A planning refund condition needs to be separately agreed.
Do not pay the deposit yet if…
- The price assumes a rebuildable home but the evidence stops at cadastral records or old registration.
- Only maintenance is allowed and nobody explains how the required structural replacement qualifies.
- The claimed route depends on a missing catalogue entry, planning instrument or decision.
- Residential use, recognised volume, illegal additions or a safety or demolition order remain unresolved.
- The contract binds you to buy even if the project on which your decision depends cannot be approved.
